It’s been almost two years since fugitive former bankruptcy trustee Paul Leroy fled the jurisdiction, having first transferred millions offshore that should have been distributed to the Health Services Union (HSU) in its capacity as the largest creditor of the two bankrupt estates of former HSU national secretary Katherine Jackson.
Leroy has never returned to Australia and his whereabouts is unknown to those he’s wronged, though iNO has heard tell of AMEX charges incurred in Parisian fleshpots and we’ve previously reported on funds Leroy transferred to a sibling in Europe.
This morning Fabian Micheletto and Michael Carrafa of SV Partners – who were appointed Jackson’s trustees after Leroy’s registration as a trustee in bankruptcy was cancelled in early 2024 – applied for judgment against the fugitive.
Predictably, Leroy isn’t expected to participate. He’s never filed a notice of appearance and would need to seek leave to file a defence. Nobody’s holding their breath.
One item of interest that did emerge from this morning’s proceedings was that Katherine Hangman, the barrister appearing for Micheletto and Carrafa, confirmed to the court that the trustees had been able to resolve a matter with a party they had indicated they would seek to have joined to the proceedings.
This may well have been a reference to Leroy’s former employer Mackay Goodwin and its professional indemnity insurer, who iNO understand the trustees were at one point considering suing.
The matter was set down for a half day trial on November 12. It’s all but certain the trustees will get judgment. But where do they go from there? Micheletto and Carrafa couldn’t be reached for comment prior to iNO’s deadline.
