Former liquidator Peter Andrew Amos has been gaoled for a minimum two years, almost 12 months to the day after pleading guilty to six charges of dishonesty and unjust enrichment.

Amos, who’s been living at Avoca while on bail, was handcuffed by corrective services officers and led from the court with his partner looking on after being sentenced to four years imprisonment today by District court judge Robyn Tupman.

On December 14, 2023 Amos signed a statement of agreed facts admitting that between 2016 and 2022 he transferred almost $2.5 million linked to five external administrations (Exads) under his control to three NAB accounts, two of which he operated as sole signatory and one operated jointly with his now ex-wife.

The charge sheet records six charges of use position dishonestly to gain advantage and cause detriment.

iNO understands that despite receiving $12,000 per month in income protection insurance it’s Amos’s ex-wife who is on the hook to make good.

The liquidators of Amos’s insolvency practice are demanding payment of $970,000 and the ATO is chasing the former Ms Amos for almost $1.22 million.

The misappropriated funds were used to pay business and personal expenses including wages for Amos Insolvency, electric vehicle purchases, travel, $20,000 to the Frensham boarding school for girls and ATO debts.

In 2019 and again in mid-2021 Amos files were scrutinised by reviewing liquidators engaged by ASIC but it wasn’t until ARITA relayed concerns brought to it by a member in October 2021 that ASIC turned up the heat, requesting in November 2021 that Amos provide specific information relating to various administrations including Mikcon Employment Services Pty Ltd.

For almost 12 months Amos declined to provide the material requested, material which would have shown that he was taking from the administration accounts monies well in excess of the amounts approved by creditors.

iNO makes no suggestion of wrongdoing in relation to Ms Amos who has not been charged with any crime.

Amos will be eligible for parole in December 2026.
