The bid to terminate the Kentel Australasia Pty Ltd (Kentel) DoCA and oust deed administrators Quentin Olde and Liam Healey was quietly put to the sword last week.
Wielding the blade was Federal Court judge Michael Lee, who dismissed the proceedings brought by Kentel director Ben Scott, and made him liable for Olde and Healey’s costs as well as his own.
We’ll have to wait for the judgment to be delivered before Justice Lee’s reasons can be raked over but the outcome shows yet again how high an applicant must hurdle to succeed in removing external administrators.
Scott’s been in dispute with former friend and ex-Kentel director James Kennedy for some time and was incensed at the DoCA terms which relinquished claims Scott believed should be pursued against Kennedy, who resigned as a director in 2022.
